These general conditions of sale apply to all commercial transactions made in our webshop, www.maxhorse.cat, hereinafter The Seller. For more information about the Seller and our Privacy Policy, see the disclaimer located at the bottom of each page of this store.

Please read these Terms of Purchase and our Privacy Policy carefully before placing your order. If you are not in accordance with all the Purchase Conditions and the Privacy Policy, you must not place an order.

 

  1. ID
    Maxhorse - Catharina Hoenderkamp, provided with VAT number ES- X5362403E, is c ompany established in C/ Josep Pla 12 C 5-1, 17252, Sant Antoni de Calonge, Spain.

  2. Activity
    The Seller is a webshop specialized in selling saddlery and equestrian products.

  3. Content and information provided on the website
    The Seller reserves the right to modify the commercial offer presented on the website (modifications on products, prices, promotions and other commercial and service conditions) at any time. The Seller makes all the efforts within its means to offer the information contained in the website in a truthful way and without typographical errors. In the event that at any time there is an error of this type, alien at all times to the will of The Seller, it would be immediately corrected. If there is a typographical error in any of the prices shown and a customer has made a purchase decision based on that error, the seller will notify the customer of the error and the customer will have the right to cancel your purchase without any cost on your part.

    The contents of the website The Seller could, at times, show provisional information about some products. In the event that the information provided does not correspond to the characteristics of the product, the client will have the right to rescind his purchase without any cost on his part.

    The Seller is not directly or indirectly responsible for any of the information, contents, statements and expressions contained in the products marketed by The Seller. Said responsibility rests at all times on the manufacturers or distributors of said products. The client understands that the Seller is a mere intermediary between him and said manufacturer or distributor.

  5. Applicable taxes
    The prices in Euros of the products exhibited on the website of the Seller, include the Value Added Tax (VAT) and all applicable taxes in Spain.

    Customs expenses and import taxes that are not included in the shipment, must always be paid at destination by the recipient of the goods. In no case can we determine the amount of these taxes.

    Purchases that will be delivered within the territory of any of the member states of the European Union will be subject to VAT.

    Purchases that must be delivered in the territories of non-member states of the European Union, or in the Canary Islands, Ceuta or Melilla will be exempt from VAT.
  6. Way to pay
    When making the order, the customer can freely choose to pay the purchases made by card; counter-reimbursement (only in Spain and Portugal) or other analogous means. In certain cases and to prevent possible fraud, the Seller reserves the possibility of requesting a specific form of payment from a client in the event that the identity of the buyer is not reliably proven. The website uses information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorized data access. To achieve these purposes, the user / client accepts that the provider obtains data for the purpose of the corresponding authentication of the access controls. Any hiring process or that involves the introduction of personal data will always be transmitted through secure communication protocol (HTTPS: //) in such a way that no third party has access to the information transmitted electronically.

  7. Form, expenses and delivery time
    The customer can select the shipping method from among the possible ones for his shipping area. You should bear in mind that delivery times, quality of service, delivery point and cost will be different for each form of transport.

    The Seller sends the orders to its customers through different urgent transport companies of recognized national and international prestige. The delivery date at the customer's address depends on the availability of the chosen product and the shipping area. The indicative transport periods are available in the section of our website «Shipping Costs». Before confirming your order, the client will be informed about shipping costs and transport terms, both indicative, that apply to your specific order. However, both may vary depending on the specific circumstances of each order. Especially:
    * The transport periods can be altered by extraordinary incidents in the carrier and by difficulties in the delivery of the merchandise.
    * The shipping costs that appear on the web when ordering.

  8. Buyer's rights and return policy
    The Seller does not guarantee to its customers the availability or delivery time of the products offered on its website, except for the products in which a certain guarantee is expressly cited. The catalog that is shown is merely indicative since the manufacturers or distributors do not communicate the stocks in advance or guarantee delivery times. This situation prevents the Seller from being able to accurately inform its customers about the availability of the products as well as to guarantee a certain delivery time which, in any case, will depend on the time it takes the manufacturer or the distributor to supply the product.

    The Seller guarantees its customers the possibility of canceling their order at any time and without any cost provided that the cancellation is communicated before the order has been made available to the carrier for shipment or manufactured by Maxhorse in the case of products by charge.

    The client will have a period of fourteen days from the receipt of the order to terminate the contract and return the purchased product. The client will inform The Seller within the stipulated period and by any means admitted by law, his desire to exercise the right to terminate the contract. The returned order must be delivered in its original packaging without being used together with the delivery note and, if applicable, invoice issued to the Seller, with the Buyer handling the return costs.

    The customer may return any item (custom made Biothane products) that he has purchased from The Seller, provided that the products have not been opened or used and retain their seal or original packaging. In these cases, the Seller will return the purchase money by means of a credit card payment, by means of a bank transfer to the account indicated by the customer or by means of a credit to his personal account.

    If a product other than that requested by the customer was delivered by mistake of the Seller, it will be removed and the correct product will be delivered without any additional charge to the buyer.

    The European Commission provides an online dispute resolution platform, which is available at the following link: http://ec.europa.eu/consumers/odr/. Consumers may submit their claims through the online dispute resolution platform.     The return policy does not apply to custom made Biothane products.

  9. Obligations of the client
    The client of The Seller undertakes at all times to provide truthful information about the data requested in the user registration forms or order fulfillment, and to keep them updated at all times.

    The client undertakes to accept all the provisions and conditions contained in these General Contracting Conditions, understanding that they include the best possible service will for the type of activity carried out by the Seller.

    Likewise, it undertakes to keep confidentially and with the utmost diligence its personal access codes to our website.

    The client undertakes to enable the delivery of the requested order by providing a delivery address where the requested order can be delivered within the usual schedule of delivery of goods (Monday to Friday from 10:00 a.m. to 1:30 p.m. and from 16 p.m. 00 to 18:00). In case of default by the customer of this obligation, the Seller will not have any responsibility for the delay or impossibility of delivery of the order requested by the customer.

  10. Applicable legislation and competent jurisdiction
    The purchases made with the Seller are subject to the legislation of Spain.

    In case of any conflict or discrepancy, the applicable jurisdiction will be that of the Courts or Tribunals of the buyer.
